Many also believe that the compensation given in a serious accident can fall in the millions range. However these are common legal misconceptions that unfortunately most of the public is not aware of.

    Below are a few legal facts to clarify what you can expect when it comes to compensation in a serious injury:

    1. No Insurance, No Compensation

    If you do not have car insurance and are involved in an accident, you will not be able to recover for your pain and suffering and permanent disability, even if the accident was completely the other person’s fault and they have insurance.

    2. There’s a Cap 

    If you are severely injured in an accident (for example paralyzed from the neck down) the money you and your family can recover for your pain, suffering, and permanent disability is limited to $1 million. This law remains firm even if the accident was 100 percent the other person’s fault and they have unlimited insurance and resources. 

    3. Things are Limited 

    If you are hurt on the job because your employer or coworker were “grossly negligent“, you cannot actually sue them for the full amount of your damages. Instead, you must take the limited benefits provided by workers compensation insurance.
