Allen Lee was part of a cyclist group that was riding down Grizzly Peak Boulevard on September 24, 2011. When Lee hit a rut, his front tire became stuck and he was immediately flung over his handlebars and into a moving vehicle. Lee died as a result.
Lee’s wife and children have filed a lawsuit against the City of Oakland claiming that they violated Government Code by failing to fix up the roadways when they are in conditions that prove to be dangerous. There have also been many complaints about the roadway’s condition, in which the city didn’t take any measure to correct.
For many years, the roadway has been in poor condition despite the complaints. It took Lee’s death for the city to take the initiative and fix it.
Lee’s family is seeking compensation for what they believe to be a wrongful death claim and lawsuit. Only time will tell what happens with this case and if they will get the compensation they rightfully deserve.
