Federal Tort Claim Act
When a person is injured by another person acting on behalf of the United States, the injured individual is entitled to sue the U.S. in federal court according to the Federal Tort Claim Act. This allows the injured person/party to gain compensation for their injuries.
What should you know about the Federal Tort Claim Act?
- Only actions of federal employees can be the basis for an FTCA claim.
- The negligent act that resulted in the injury of a person must be within the general area of the defendant’s job description to be pursued under the FTCA.
- The claim will be based on the law in the state in which the negligence occurred.
